EDICTAL CITATION

1. On or about April 2026 and upon the application of NEDBANK LIMITED (the Applicant), a bank duly registered and incorporated in terms of the Banking Laws of the Republic of South Africa, this court made an order in the following terms:

1.1. That the Applicant be given leave to sue WARREN JOHANSSON and LENTELI JOHANSSON (the First and Second Respondents) by edictal citation for judgment in the following terms:

1.1.1 Payment of the sum of R1 834 498.28 together with interest thereon calculated daily and compounded monthly at the rate of 11.45% from 01 September 2024 to date of final payment;

1.1.2 An order declaring specially executable property described as:

A unit consisting of –

(a) Section Number 1 as shown and more fully described on Sectional Plan Number SS157/1987 in the scheme known as AMAWELE in respect of the land and building or buildings situated at CATO MANOR, IN THE ETHEKWINI MUNICIPALITY, of which section the floor area according to the said sectional plan is 192 (one hundred and ninety-two) square metres in extent; and

(b) an undivided share in and to the common property in the scheme apportioned to the said section in accordance with the participation quota on the said sectional plan.

1.1.3 Costs of suit on an attorney and client scale.

1.1.4 Further and/ or alternative relief.

1.2. That the citation in the form to be approved and signed by the Registrar be served upon the Respondents by way of Registered email to the following email address: wjohansson9@!gmail.com and lloots2@gmail.com and also to be served at the property address being Section 1 Amawele, 19 Charles Grove, Manor Gardens, Cato Manor, Durban

Alternatively;

1.3. That the citation in the form to be approved and signed by the Registrar be served upon by publication in “the Irish Sun” Newspaper.

1.4. That the Respondents, if they wish to oppose the said application, shall give notice of their intention to do so to the Registrar of this court and to the Applicant's attorneys within twenty (20) days after service upon them of the said citation.

2. The registrar of this Honourable Court has approved and signed this form of citation.

NOW THEREFORE YOU ARE INFORMED that the application brings an application against you, the abovenamed Respondents, WARREN JOHANNSON and LENTELI JOHANSSON, presently residing in Ireland, in which application the applicant claims the relief on the grounds set out in paragraph 1 above.

YOU ARE INFORMED that if you, the Respondents, dispute the claim, and wish to oppose the application, you shall:

(a) within twenty (20) days after service upon you of the citation, file with the Registrar of this court at C/O Somtseu and Stanger Street, Durban, KwaZulu-Natal, South Africa, notice of intention to oppose and serve a copy thereof on the Applicant's attorneys, GARLICKE & BOUSFIELD INC, 7 Torsvale Crescent, La Lucia Ridge Office Estate, La Lucia, Durban, KwaZulu-Natal, South Africa, email address Busisiwe.mpunga@gb.co.za which notice shall give an address referred to in Uniform Rule 6(5)(b) for the service upon you of all notices and documents in the action;

(b) thereafter and within twenty (10) days after filing and serving notice of intention to oppose as aforesaid, file with the registrar and serve upon the Applicant's attorneys, your answering affidavit.

YOU, THE RESPONDENTS, ARE HEREBY INFORMED FURTHER that, if you shall fail to file and serve notice of intention to oppose, as aforesaid, judgment as claimed may be given against you without any further notice to you, or if, having filed and served such notice, you fail to oppose, judgment may be given against you.
